    Competitive Pest Services (“CPS”, “we”, “our”, “us”)

    1. Acceptance of Terms

    By accessing or using the CPS website, requesting a quote, entering into a service agreement, or otherwise engaging with us, you agree to be bound by these Terms & Conditions (“Terms”). If you do not accept these Terms, please do not use our services or website.

    2. Website Use

    • The CPS website and its content are provided “as is” and “as available,” without warranty of any kind, whether express or implied, including warranties of merchantability, fitness for purpose, non-infringement, or accuracy.

    • CPS makes no guarantee that the website is free from errors, viruses, or other harmful components.

    • CPS shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the website, except to the extent prohibited by law.

    • If a jurisdiction does not permit limitation or exclusion of liability, CPS’s liability will be limited to the maximum extent permitted by law.

    3. Services & Quotations

    • CPS offers pest control services based on site inspections, quotes, and mutually agreed terms.

    • All quotes are estimates and subject to change if actual site conditions differ materially from those seen during inspection (e.g., hidden damage, access issues).

    • Quotation validity: A quote is valid for [e.g. 30 days] unless otherwise stated.

    • Additional work beyond the original scope will require a variation order or supplemental agreement, which may incur extra costs.

    5. Customer Obligations

    • You must provide accurate information about the property, pest history, site access, and relevant hazards or constraints.

    • You agree to afford CPS safe and unobstructed access to areas that require inspection or treatment.

    • You must follow any preparation instructions (e.g. vacating rooms, removing stock, sealing food, etc.) that CPS issues.

    • You are responsible for securing pets, food items, and valuable or delicate property during treatment. CPS is not liable for damage to items left in treated zones contrary to instructions.

    6. Safety, Compliance & Liability

    • CPS will perform services in compliance with relevant laws, regulations, safety standards, and industry best practices.

    • CPS disclaims liability for issues arising from negligence, misuse, or lack of cooperation by the customer or third parties.

    • To the fullest extent permitted by law, CPS’s total liability to you for any claim (contractual, tort, or otherwise) will be capped at the total fees you paid for the particular service at issue.

    • CPS is not responsible for consequential, indirect, or incidental damages, lost profits, business interruption, or reputational harms.

    7. Intellectual Property

    • All content on the CPS website — text, images, logos, graphics, design — remains the intellectual property of CPS or its licensors.

    • You may use site content for personal, non-commercial purposes only, provided you retain all copyright and proprietary notices.

    • Unauthorized copying, distribution, modification, or use of site content for commercial gain is prohibited.

    8. Privacy & Data

    Your use of CPS’s services and website is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect your personal information.

    12. Governing Law & Dispute Resolution

    • These Terms are governed by the laws of the State or Territory in which CPS operates (e.g. New South Wales, Queensland, etc.).

    • Any dispute or claim relating to these Terms or CPS services shall be resolved by mediation first; if unsuccessful, by courts of competent jurisdiction.

    13. Entire Agreement

    These Terms, along with any service agreement, quotes, schedules, and the Privacy Policy, represent the entire agreement between you and CPS regarding the subject matter, and supersede all prior representations, understandings, or communications.
